NEW DELHI: Congress spokesperson and lawyer Randeep Singh Surejewala on Wednesday moved the Supreme Court seeking to be a party in the sun motu proceedings initiated by it to provide succour to migrant workers facing hardship due to lockdown and put forth Congress's suggestions to ameliorate the workers' condition.
He said since Parlaiment has not been in session due to lockdown, the opposition parties, especially Congress, has not been able to raise the issue there. It was further hindered by the Centre's failure to set up a joint committee with opposition parties to address the issue of migrant workers.
Because of these reasons, the Centre is unable to "consider the measures suggested by the Applicant and the opposition party or any member of Parliament not belonging to the ruling dispensation," Surjewala said in his application filed through advocate Sunil Fernandes.
He suggested to the SC to direct preparing a list of stranded migrant workers by conducting a district and village wise survey. "Government of India may immediately set up reception centres and facilitation centres at district and village level for receiving labourers and facilitating further travel of the labourers to their native districts/villages.".

 He said the urgent need is to frame a national action plan to address the issue stranded migrant labourers and ensure food, medicine and shelter to each of them. "They are at present dependent on the largesse of private individuals for the basic needs," he claimed.
Surjewala said the financial relief announced by the Centre recently "should be implemented on an urgent and immediate basis and a public announcement detailing the reliefs with timelines
and step-wise procedure of release should be shared with the public and migrants."

 He said since the stranded migrants have been uprooted from places of gainful employment, "the Centre should formulate urgent and immediate schemes for providing gainful employment to
the migrant labourers, with additional and specific schemes, which take into consideration the education of the migrant labourers’ children and the general well being of their family members." The government should reach out to migrant workers thorough all communication modes including radio to explain the benefits promised to be provided to them.

The government has issued a notification with retrospective effect enabling the treatment of contributions made by companies to the Prime Minister’s Citizen Assistance and Relief in Emergency Situations (PM CARES) Fund, formed in the aftermath of the coronavirus disease pandemic, as corporate social responsibility (CSR) spending.
Requests by some states, including West Bengal, to allow contributions made to the Chief Minister’s Relief Fund to be treated as CSR expenditure were declined, two officials aware of the matter said on condition of anonymity.
“It is because this will restrict the use of the bulk of CSR funds in only 6-7 industrialised states where most of the companies are located,” one of the officials said.
The notification to include PM CARES in Schedule VII of the Companies Act, 2013, related to CSR, along with the Prime Minister’s National Relief Fund, was issued on Tuesday. “This notification shall be deemed to have come into force on 28th March 2020,” it said. HT has seen a copy of the notification.
PM CARES Fund was set up on March 27 to deal with the coronavirus (Covid-19) pandemic. It announced its first allotment of Rs 3,100 crore on May 13 for ventilators, the welfare of migrant workers, and supporting a programme to develop a vaccine against Covid-19.
The official quoted above cited past instances wherein two industrial states--one in the north and another in south India--had tried to “arm-twist” companies located in their regions to spend their entire CSR money locally. “Such tendencies need to be curbed for equitable distribution of CSR funds across the country.”
HT on April 17 reported that West Bengal finance minister Amit Mitra wrote to Union finance minister Nirmala Sitharaman urging the Centre to include the CM’s Relief Fund in Schedule VII of the Companies Act.
The Companies Act requires firms with a net worth of Rs 500 crore or more, or turnover of Rs 1,000 crore or more, or net profit of Rs 5 crore or more in the immediately preceding financial year, to mandatorily spend 2% of average net profit of the preceding three years on CSR.
Money earmarked for spending on CSR activities is about Rs 15,000 crore a year. According to an industry estimate, about Rs 50,000 crore has been spent on CSR since 2014-15 and around Rs 30,000 crore remains unspent.
A company’s board is empowered to plan, decide, execute, and monitor the activities under CSR on the recommendations of a committee. The government has specified broad areas of spending in Schedule VII.
Approved activities under CSR include eradicating extreme hunger, poverty, promotion of education, promoting gender equality and women’s empowerment as well as reducing the child mortality, improving maternal health and combating diseases. Ensuring environmental sustainability and prompting employment enhancing vocational skills are other activities approved under CSR.

Indian Army chief General Bipin Rawat admits to intel reports
NEW DELHI: The time has come for India to adopt a "whole-of-government approach" in decisively confronting the "strategic uncertainties" looming on its horizon as well as non-traditional threats like pandemics, Army chief Gen Manoj Mukund Naravane has said, strongly pitching for broadening the country's national security doctrine.
Talking about complex geo-political power play in India's neighbourhood, Gen Naravane said the Indian armed forces are determined to "cement" the country's reputation as a net security provider in the region.

 "There is an entire spectrum of strategic uncertainties that looms on the horizon and a whole-of-government approach is the need of the hour to deal with them," the Army Chief told PTI.
Though Gen Naravane did not elaborate, his comments came in the backdrop of Pakistan-supported Taliban's aim for a role in power structure in Afghanistan and China's persistent efforts to expand military ties with countries like Sri Lanka, Nepal, Myanmar and the Maldives.
"In dealing with issues of global nature, the armed forces with their inherent capabilities and capacities will cement India's reputation as a net security provider in the region, taking security as a holistic concept," Gen Naravane said.
India is learnt to have been worried over the extremely fragile and dynamic situation in Afghanistan after the US sealed a historic deal with the Taliban providing for withdrawal of American troops from the war-ravaged country.
The Army Chief further said that India needs to broaden its understanding of national security and must examine non-traditional threats like pandemics "de-novo" as they have the potential to inflict severe damage on the country. "We need to act and prepare ourselves accordingly."
He said the "traditional threats" facing India remained "unabated" and the armed forces are fully geared up to deal with them.
Gen Naravane said that there has been no let up in Indian Army's "posture" while guarding the Line of Actual Control (LAC) with China because of the coronavirus pandemic. The LAC is the de-facto border between the two countries.
"Along the LAC, patrolling continues as before though we have put the ceremonial border personnel meetings on hold. There is also greater reliance on hotlines," he said.
The Chief of Army Staff said the effort has been to adhere to the directives issued by both the governments following two informal summits between Prime Minister Narendra Modi and Chinese President Xi Jinping.
"As far as our deployment along the border with China is concerned, the focus is on mutual understanding and respect for the sanctity of LAC and ensuring that no untoward incident takes place due to our differing perceptions of the LAC," he said.
"Our focus has been to ensure all misunderstandings are mitigated amicably through discussions and existing mechanisms," Gen Naravane said.
The India-China border dispute covers 3,488-km-long Line of Actual Control. China claims Arunachal Pradesh as part of southern Tibet while India contests it.
Both sides have been asserting that pending the final resolution of the boundary issue, it is necessary to maintain peace and tranquillity in the border areas.
Gen Naravane said troops deployed along borders in remote and high altitude areas are at minimum risk of getting infected by the coronavirus as the areas are inaccessible to ordinary people.
He said only troops who are medically validated as being coronavirus-free are being allowed to replace the personnel deployed in key formations and frontiers.
"You have to keep in mind that in most of these places, due to the nature of deployment and living arrangements, social distancing is not feasible. However, wherever possible, social distancing and hygiene measures are being strictly enforced," he said.
Gen Naravane said ensuring safety of his force from the pandemic is his foremost priority as the Army will be able to assist the country in dealing with the challenge if the troops are fighting fit.
"The need for maintaining social distancing and hygiene norms assumes significant importance in the forces because of the higher density of personnel living inside barracks and the increased attendant possibility of the virus spreading within the forces," he said.
He said all the units and formations have been issued comprehensive instructions to maintain social distancing wherever feasible and adhere to highest hygiene standards.

Indian, Chinese Soldiers Face-Off Along Sikkim Border; Matter ...
Scores of Indian and Chinese soldiers were involved in a tense face-off along the India-China boundary in north Sikkim on Saturday, two senior officials said on the condition of anonymity.
The aggressive confrontation between the troops from the two sides happened near the Naku La sector (ahead of Muguthang), a pass at a height of more than 5,000 metres, said the first officer cited above.
Several soldiers were injured in the border stand-off as they exchanged blows.
“Four Indian soldiers and seven Chinese troops suffered injuries during the confrontation that involved around 150 soldiers,” said the second officer cited above.
He said the face-off was resolved at the local level.
Two officials Hindustan Times spoke to in the Army Headquarters denied knowledge of the face-off.
The Naku La area was traditionally not prone to face-offs, a former top commander said.
This is not the first time Indian and Chinese soldiers have exchanged blows along the border. In August 2017, Indian and Chinese soldiers threw stones at each other and also exchanged blows near Pangong Lake in Ladakh, close to the de facto border between the two countries.
The clash near the Line of Actual Control (LAC) aggravated bilateral tensions as it happened at a time when the two neighbours were locked in a long stand-off in the disputed Doklam plateau close to Sikkim.
The 73-day Doklam stand-off between India and China along the Sikkim border was likely to be the new normal, the Centre for Joint Warfare Studies (CENJOWS) said in 2017, making a strong case for building military capabilities. The stand-off ended with the withdrawal of troops by both armies.

Hong Kong police arrested at least 14 veteran pro-democracy lawmakers, activists and a media tycoon on Saturday on charges of joining unlawful protests last year calling for reforms.
Among those arrested were 81-year-old activist and former lawmaker Martin Lee and democracy advocates Albert Ho, Lee Cheuk-yan and Au Nok-hin.
Police also arrested media tycoon Jimmy Lai, who founded the local newspaper Apple Daily.
Lai, Lee Cheuk-yan and Yeung Sum — a former lawmaker from the Democratic Party — were charged in February over their involvement in a mass anti-government demonstration on Aug. 31 last year. The protests in the semi-autonomous Chinese territory against proposed extradition legislation exposed deep divisions between democracy-minded Hong Kongers and the Communist Party-ruled central government in Beijing.
The bill — which would have allowed Hong Kong residents to be sent to mainland China to stand trial — has been withdrawn, but the protests continued for more than seven months, centered around demands for voting rights and an independent inquiry into police conduct.
While the protests began peacefully, they increasingly descended into violence after demonstrators became frustrated with the government’s response. They feel that Hong Kong leader Carrie Lam has ignored their demands and used the police to suppress them.
The League of Social Democrats wrote in a Facebook post on Saturday that its leaders were among those arrested, including chairman Raphael Wong. They were accused of participating in two unauthorized protests on Aug. 18 and Oct. 1 last year.

Acrid smoke from wildfires, including blazes near the defunct Chernobyl nuclear plant, has blanketed Ukraine's capital Kyiv, making its air pollution among the worst in the world.
Kyiv's pollution now ranks alongside that of several Chinese cities, Swiss monitoring group IQAir reports.
The coronavirus lockdown is keeping most Kyiv residents at home anyway.
Ukraine's health ministry says radiation levels remain normal and Chernobyl faces no immediate threat.
At one point on Thursday, according to the IQAir index, Kyiv's air pollution was the worst in the world.
But the dramatic global slump in economic activity, caused by the coronavirus pandemic, has made the air in many cities cleaner. That partly explains why Kyiv's smog looks especially bad now.
The Chernobyl plant was the scene of the world's worst nuclear disaster in 1986, when an accident blew the roof off a reactor, sending a radioactive plume across Europe.
Firefighters have been tackling wildfires in the Chernobyl zone and in areas nearer to Kyiv, and there was a new flare-up fanned by strong winds on Thursday. But the emergency services say fire has not spread to the Chernobyl power station area.
The plant is surrounded by a 30km (19 mile)-radius exclusion zone, created in 1986 because of radioactive hotspots. It includes the abandoned settlement of Pripyat.
The health ministry has urged Kyiv's roughly 3.7m people to stay indoors and close windows, Reuters news agency reports.
The ministry warns that the smog can cause headaches, coughs, difficulty breathing and inflammation.

He said that the employees of North DMC are cleaning roads and streets, sanitizing areas, marking signs in markets and other places to maintain social distance every day. He said that we have to make efforts now to prevent dengue, malaria and chikungunya, only then we will be able to stop them from spreading.
